Residential Parking Permits

Residential Permit Zones primarily cater for properties who cannot, due to heritage or other special character constraints establish onsite parking and experience either low parking availability due to narrow streets or high parking demand.

A residential parking exemption (permit) will only be issued in limited circumstances under the following Eligibility Criteria:

  • The dwelling unit is the principal place of residence of the applicant.
  • If a residential property has access to sufficient off-street parking spaces, then that property is not eligible for a residential parking permit. Utilisation of garaging or driveway space for other purposes will not be considered as meeting these criteria.
  • Availability of permits will be dictated by a range of factors including availability of on street parking, and available supply of off-street parking.
  • A Residential Parking Permit is subject to an annual fee in accordance with Council’s fees and charges register. Fees are payable prior to receiving a permit, and permits will not be valid prior to receipt of payment and formal issue of the permit.
  • Applicants shall produce evidence of vehicle ownership and registration to the address a permit is sought for prior to the issue of a permit.
  • The permit shall only apply within the area defined by the Council and in the manner specified by the Council.
  • The permit to expire if the applicant ceases to reside on the premises and no refund of the charge, if applicable, will be made.
  • Permits can only be issued against the registration of a currently unconditional South-Australian registered vehicle which is not a truck (exceeding GVM4500), trailer, caravan, boat, bus, motorcycle, or conditionally registered vehicle.
  • No residential parking permits be issues to the owner(s) or occupier(s) of dwellings within a multi-unit residential development, including but not restricted to, apartments and town house, in cases where consent for that building was granted on or after 1 November 2013.

Please note: You must submit an application annually and pay an annual fee for a Residential Parking Permit.

BEFORE SUBMITTING YOUR APPLICATION:

Submitting an application will mean an invoice for the annual fee is levied. Permits are only issued upon payment of the fee. You may be expiated if you park within a signed permit zone without a valid residential parking permit displayed.

Applicants need to provide supporting documents- either a copy of their Registration Details Certificate- (this can be downloaded via your SA.gov.au webpage account: https://www.sa.gov.au/mysagov via the link under ‘Your Records’- ‘Download Registration Details Certificate’) or the registration renewal letter.

If your vehicle is registered to a company or another address, please provide either:

  • an insurance policy showing vehicle is garaged at the property
    or
  • a copy of the property lease to confirm you live at the address and the vehicle is registered to you.

An administration fee applies for replacement requests for any lost permits of $15 unless an extenuating circumstance can be evidenced- (e.g. police report noting burglary from vehicle/ vehicle written off etc.)

Please send an email to admin@prospect.sa.gov.au with “Parking Permit replacement - your address here” as the subject and attach any supporting documents.

You will be invoiced the fee, and until the fee is paid and a replacement permit issued, you may be expiated if you park in the zone and don’t display a valid permit in alignment with the terms and conditions of the permit.

Residential Parking Permit holders can change the vehicle a residential permit is issued against once free of charge within the validity period, provided documentation shows the vehicle is still registered to the same person at the same address or unless an extenuating circumstance can be evidenced.

Please reapply using the form above and provide updated details. Any further changes will require a new permit administration fee to be paid of $15 per request.

Should you wish to request a fee waiver, you will need to send an email addressed to the Council’s Chief Executive Officer (CEO) outlining reasons why.

The CEO cannot honour past waivers unless compelling hardship can be demonstrated. You can attach this letter to your application.

Access to sufficient off-street parking is generally in line with the former Residential Code and current Planning, Development and Infrastructure (PD&I)  Act 2016 and is defined as:

  • Providing at least two (2) car parks for two-bedroom infill housing/ single title dwellings
  • Providing at least one (1) carpark for properties on strata or unit titles built prior to 1 November 2013.
  • Dwellings within a multi-unit residential development, including but not restricted to, apartments and town house, in cases where consent for that building was granted on or after 1 November 2013 are ineligible for permits.
  • Properties with two or more off street carparks would generally not be eligible for a Residential Parking Permit.

Minimum vehicle dimensions envelope set out in AS2890.1-2004 Figure 5.2 Design Envelope around Parked Vehicle will be used to assess if an off-street parking space is sufficient and practically able to be utilised as parking or if on-site parking could reasonably be provided.

Whether or not a property has access to Sufficient Off-street parking will be established by conducting a review of the following:

  • - A review of any approved parking arrangements under an approved Development Application, Strata Plan or S221 Crossover Permit.
  • -       A review of the property applying including applying the Minimum vehicle dimensions envelope set out in AS2890.1-2004
  • -       Permit/s will not be issued if parking spaces could reasonably be provided on the property, and where an application is made, and it is established that on-site parking could reasonably be provided the application will be declined with no refund of the permit fee.

Based upon assessment of the above criteria:

  • - Properties with no off-street parking and no ability to provide a space would be eligible for at least one permit.
  • - Properties with one off-street carpark who held a Residential Parking Permit prior to 2022 would be eligible for the number of permits held under legacy arrangements.
  • - Properties with two or more off street carparks would generally not be eligible for a Residential Parking Permit.

Minimum vehicle dimensions envelope set out in AS2890.1 will be used to assess if an off-street parking space is sufficient and practically able to be utilised as parking or if on-site parking could reasonably be provided.

Note: many properties with heritage or special character constraints that prevent establishment of off-street carparking are also on narrow streets with limited on street parking resource to allocate. Council reserves the right to reconfigure the layout of Legacy Residential Parking Zones also for the above reasons and cannot guarantee in perpetuity that these zones will remain in front of individual properties, therefore zones with permit caps may need to be considered.

A dedicated signed Permit Zone implemented in front of a property prior to 2020 due to the property being unable to establish off-street parking and where a Residential Parking Permit has been continually maintained between 2018-2023.

Properties with one off-street carpark who held a Residential Parking Permit prior to 2022 would be eligible for the number of permits held consistently under legacy arrangements.

Where Permit zones are currently installed, and residents have previously been issued a permit between 2018-2022, if no onsite changes have been undertaken to add or increase onsite parking within this period, they will be offered an amnesty to either obtain a permit in the 2023 Residential Permit Round beginning from June 30- August 30 2023 and have the permit zone considered a legacy zone.

To provide equitable access and sufficient numbers of parking spaces future schemes may not be able to provide Permit Parking spaces in front of individual properties, but within a defined zone. This is due to road safety requirements, road geometry and narrow street treatments or street feature placement. Note many properties with heritage or special character constraints that prevent establishment of off-street carparking are also on narrow streets with limited on street parking resource to allocate.

Council reserves the right to reconfigure the layout of Legacy Residential Parking Zones also for the above reasons and cannot guarantee in perpetuity that these zones will remain in front individual properties, therefore zones with permit caps may need to be considered.

Permits exempt the holder from parking time restrictions in specified areas and allows the holder the opportunity to park close to their residential property but does not guarantee parking availability. Numbers of permits issued in an area need to consider the local street environment and available legal car park supply to balance parking demand and supply, therefore permit numbers will be assessed on a street-by-street basis to ensure equitable opportunity to access on street carparking.

To provide equitable access and sufficient numbers of parking spaces future schemes may not be able to provide Permit Parking spaces in front of individual properties, but within a defined zone. This is due to road safety requirements, road geometry and narrow street treatments or street feature placement. Note many properties with heritage or special character constraints that prevent establishment of off-street carparking are also on narrow streets with limited on street parking resource to allocate.

Council reserves the right to reconfigure the layout of Legacy Residential Parking Zones also for the above reasons and cannot guarantee in perpetuity that these zones will remain in front individual properties, therefore zones with permit caps may need to be considered.

Availability of permits will be dictated by a range of factors including availability of on street parking, and available supply of off-street parking.

Parking permit caps which reflect the surrounding land use and parking demand, and availability are recommended to ensure a maximum percentage of available carparking is allocated to ensure adequate parking availability and turnover.

Permit Scheme Cap Guidance:

Residential Zones with interface with a commercial zone - a 60%/40% split is recommended for balance between parking supply and issued permits to ensure availability and turnover.

Residential Zones with no Commercial interface- Recommended permit cap up to 75% of available parking spaces within a zone to still provide turnover and availability for visitors and services.

Second permits may be considered in line with recommended permit caps on a street-by-street basis to ensure equitable opportunity to access on street carparking. An Expression of Interest (EOI) process would be used to consider any permit requests from those with one permit or those with one off-street carpark for residual permits after allocation to properties with no access to off-street parking were complete to ensure equal access and individual need was considered.

Note: many properties with heritage or special character constraints that prevent establishment of off-street carparking are also on narrow streets with limited on street parking resource to allocate. Council reserves the right to reconfigure the layout of Legacy Residential Parking Zones also for the above reasons and cannot guarantee in perpetuity that these zones will remain in front individual properties, therefore zones with permit caps may need to be considered.

Where new parking restrictions are implemented through consultation, and a property is identified which has no access to any off-street parking and is unable to provide off-street parking, and they have reasonably been able to park within the street and not be impacted by parking restrictions previously, a permit zone to exempt the holder from parking restrictions in specified areas that allows the holder the opportunity to park close to their residential property but does not guarantee parking availability may be applied.

Council staff will conduct a review of the Issued Residential Parking Permit Register vs established signed on-street permit zones and begin conducting consultation with adjacent residents to enable review of zones where permits have not been held continuously.

Where Permit zones are currently installed, and residents have previously been issued a permit between 2018-2022, if no onsite changes have been undertaken to add or increase onsite parking they will be offered an amnesty to either obtain a permit in the 2023 Residential Permit Round beginning from June 30- August 30 2023 and have the permit zone considered a legacy zone or the zones will be removed and any new application will then be considered against the current policy in accordance with principles (e) and (f).

This action is proposed to provide a process for review of Residential Permit Zones as empty permit zones, or situations where a neighbour is paying for a permit, and another is not and getting benefit of use of signed permit zone in some streets is creating neighbourhood issues. Council is also receiving a number of requests to remove under-utilised zones to enable the kerb side parking to be utilised by the wider community, and many of these zones have not had a valid permit issued since 2019.

Upon completion of this review, a map of legacy zones will be produced to be contained within the Operational Guideline for transparency.

If a permit zone is removed, any request for a new permit zone in that location will be assessed under the current Residential Parking Permit Policy.

An annual fee is charged per permit based upon the Fees and Charges Register for current fees.

The permit system is operated on a cost recovery basis. Council provides signage and enforcement for these zones as well as administration support.
