Payinthi (128 Prospect Road, Prospect), including Council offices, Prospect Library and Newmarch Gallery, will close on Thursday 25 April 2024 for the ANZAC Day Public Holiday.

Calls made to Council on 8269 5355 will be transferred to our after-hours service centre, but our online services will still be available, and items (excluding large toys) can be returned in our after-hours return chute on Prospect Road.

All Council services will resume on Friday 26 April 2024.

Business Permits – what’s involved and how to apply

Footpath Trading for businesses, and Mobile Food Vendors, have become parts of the Prospect council area that are enjoyed by many. To manage these well for everyone, Council has an easy, minimal-fuss permit system in place.

To encourage outdoor trading and activation, and increase footfall, City of Prospect has created a simple but succinct process to allow local businesses to apply for Footpath Trading Permits.

Mobile Food Vendors

Safe use of roads are an important consideration for Mobile Food Vendors and Council. In order to ensure that Mobile Food Vendors operate in a manner that is safe for them and everyone else, Council has policies and guidelines in place. For those who meet the criteria and can comply with these policies and guidelines, permits are available to operate Mobile Food Vendor businesses within the Prospect council area.

Some of the considerations include:

  • Sites with narrow footpaths
  • Where the site takes up significant amount of kerbside parking
  • Where it would obscure pedestrians and drivers views of the footpath

Operating any business activity on a road requires a permit, and the permit holder is liable for any breach of requirements set out in the Business Use of a Road Policy. This includes any breaches committed by their staff and volunteers.

The fee for Mobile Food Vendors is set at $68 per month or for the 2022/2023 financial year a total fee of $680 per annum, which will be reviewed annually as part of fees and charges.

For trading on an arterial road, approval from the Department for Infrastructure and Transport (DIT) may be required. These DIT approvals cannot be guaranteed by City of Prospect.

If you’re interested in operating a Mobile Food Vendor business in the Prospect council area, you must consult Council’s location rules for information regarding location requirements.

Currently, restrictions mean food trucks cannot set up within 200m of another business selling a similar product.

Food trucks are unable to operate on the same side of the road directly in front of residential premises without written consent of the occupier of the premises.

Additionally, a mobile food vendor must only operate between 8am – 10.30pm when Daylight Savings is in force, at all other times, between 9am – 9pm.

A permit holder must select a location for operating the mobile food business that does not unduly interfere with vehicles driving, parking, public transport and cycling infrastructure.
