By-laws

By-laws are local laws established by councils to deal with issues specific to the relevant council area in accordance with the statutory provisions of the Local Government Act 1999. City of Prospect has 6 new By-laws, which came into operation on 1 January 2023.

The following list of By-laws satisfies the requirements of the Local Government Act 1999 (Section 252) to have a register of the By-laws adopted by Council.

By-law 3 – Local Government Land

Council declares the following conditions apply to By-law No. 3:

  • Paragraph 4.22.2 of Council’s By-law 3 of 2015 – Local Government Land (Model Aircraft and Vehicles) shall apply to the Broadview Oval Bike Track.
  • Paragraph 4.30 of Council’s By-law 3 of 2015 – Local Government Land (Weddings) shall apply to St Helens Park, Memorial Gardens, Prospect Estate, Prospect Gardens/Narnu Wirra.
  • Paragraph 5.5.3 of Council’s By-law 3 of 2015 – Local Government Land (Playing Competition Sport) shall apply to Broadview Oval, Charles Cane Reserve/Parndo Yerta, Prospect Oval.

By-law 5 – Dogs

Council declares the following conditions apply to By-law No. 5:

Paragraph 5.1 of Council’s By-law 5 of 2015 – Dogs (Dog on Leash Areas) shall apply to the entire City of Prospect except:

Dogs can be off-leash between the times of 5-8am and 5-9pm at the following locations, excluding playground areas:

  • Broadview Oval - 26 Collingrove Avenue, Broadview
  • Prospect Oval, Menzies Crescent, Prospect
  • Prospect Gardens/ Narnu Wirra Reserve (west side lawn area) - West Terrace, Nailsworth
  • Pash Reserve - 31-33 D’Erlanger Avenue, Collinswood
  • Percy Street Reserve - 65 Percy Street, Prospect
  • Memorial Gardens - 1 Menzies Crescent, Prospect
  • St Helens Park - 39 Prospect Road, Prospect
  • Prospect Estate - 286 Prospect Road, Prospect
  • Irish Harp Reserve - 350 Regency Road, Prospect
  • Cane Oval/Parndo Yerta - 104-120 Churchill Road, Prospect

Paragraph 6.1 of Council’s By-law 5 of 2015 – Dogs (Dog Exercise Areas) shall apply to the following locations to allow for dogs to be exercised off-leash between the times of 5-8am and 5-9pm, excluding playground areas:

  • Broadview Oval - 26 Collingrove Avenue, Broadview
  • Prospect Oval, Menzies Crescent, Prospect
  • Prospect Gardens/ Narnu Wirra Reserve (west side lawn area) - West Terrace, Nailsworth
  • Pash Reserve - 31-33 D’Erlanger Avenue, Collinswood
  • Percy Street Reserve - 65 Percy Street, Prospect
  • Memorial Gardens - 1 Menzies Crescent, Prospect

By-law  7 - Amendment  By-law

Council reviewed its six By-laws in 2022, which took effect 1 January 2023.

During the review, the Parliament of South Australia via its Legislative Review Council (LRC) evaluated and certified these six by-laws, whilst recommending that Council consider amendments to exclude gender specific language and include ‘reasonable’ direction of authorised officers.

As a By-law can only be ‘changed’ by another By-law (an amending By-law), Council agreed to adopt By-law 7 - Amendment By-law to address the LRC recommendations.

Expiation Fees

The expiation fee payable for offences against By-laws to be fixed at $312.50.
