The registered vehicle owner is responsible for parking expiations issued to their vehicle
If your vehicle has received an expiation and you were not the driver or did not own the vehicle at the time of the offence, then you may complete a Nomination Form to have the expiation reissued to the correct person.
If you believe the expiation issued is incorrect, unfair, or where there is legitimate reason to have been illegally parked, you are entitled to lodge an application for waiving the offence (with supporting evidence) in writing before you pay it.
Please note, in most cases we will take a photo at the time of issuing an expiation.
If your application to waive your expiation has been denied, you may choose to elect to go to court.
When you have chosen this option for the alleged offence, a summons will be issued to attend court at a nominated date and time.
If you are found guilty, the Court may require you to pay not only a court fine as a penalty, but also prosecution and court costs and levies. A conviction may also be recorded.
Once you have chosen this option, you cannot change your mind and seek to be expiated.
If you do not choose to review or dispute the fine, but fail to pay your expiation to council, it may result in the expiation being referred to the Fines Enforcement and Recovery Unit where further penalties may apply.
