Expression of Interest to Occupy a Council Building

During the development of the Leasing and Licencing Policy there was discussion regarding the preferred process for ‘re-letting’ Council’s assets to better stimulate additional tenancies, improved accessibility, offer more services, encourage investment and build community partnerships.

Background
During the development of the Leasing and Licencing Policy there was discussion regarding the preferred process for ‘re-letting’ Council’s assets to better stimulate additional tenancies, improved accessibility, offer more services, encourage investment and build community partnerships.

The Expression of Interest process (EOI) is a proactive approach, not only to assist Council in meeting its Strategic Plan targets, but in addressing longer term management of Council building assets.

The Process
A public forum is scheduled for 3 May 2018 (5.30pm at Prospect Town Hall, 126 Prospect Road) to discuss criteria and process with prospective and incumbent tenants.

It is our approach that incumbent tenants will be required to undertake the same process; but we are looking to increase tenancies and use. To this end, if a new prospective tenant would like to make a submission they will be encouraged to communicate with the incumbent to see if a shared solution is viable in the first instance. All submissions will be received regardless of asset status and intended occupation.

The process is as follows:

  • Familiarise yourself with the (draft) Leasing and Licencing Policy. The Policy contains a copy of the standardised tenancy Agreement, which conforms with the Local Government Act and the Retail and Commercial Tenancies Act amongst other legislation. It is a common document shared by Councils, although it does vary slightly from other leases you may have seen. Feel free to seek advice on the proposed Agreement (at your own expense).
  • Read the Council’s current Strategic Plan.
  • Email Council to register your interest in the process and advise which asset(s) you are interested in. A Council officer will contact the occupying tenant to confirm access times (and a point of contact should you wish to discuss a shared proposal). Site visits are not compulsory but will strengthen your application.
  • Attend the 3 May information session at the Prospect Town Hall if you have questions or concerns.
  • Complete the Application Form and write up a cover letter or similar to support your submission.
  • Submit the Application via email to admin@prospect.sa.gov.au before 5pm on Friday 25 May 2018.

The applications will be assessed against an evaluation matrix by three (3) independent staff members and the outcomes will be presented to Elected Members for discussion.

At the June Council meeting, Elected Members will be asked to resolve to delegate authority to the CEO to negotiate final Agreements for those specific recommended (successful) applicants.

By law, these Agreements must then go out to public consultation for 4 weeks before the CEO can execute them on behalf of Council. It is therefore anticipated the Agreements will be executed in August 2018 for October occupation.
